1.1 About These Terms
These Terms of Use ("Terms") govern your access to and use of the online payment services operated by Natural Medic Pty. Ltd. ABN 96 613 892 792 ("Practice", "we", "us", "our") for the purposes of booking and paying for healthcare consultations and related services.
By completing any payment or booking through this platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not proceed with payment.
1.2 Nature of Services
The Practice provides the following registered and regulated healthcare services under the Health Practitioner Regulation National Law Act 2009 (Cth) ("National Law"):
Chiropractic services - provided by practitioners registered with the Chiropractic Board of Australia (CBA) under AHPRA;
Chinese medicine services - including acupuncture, Chinese herbal medicine, and Chinese massage therapy - provided by practitioners registered with the Chinese Medicine Board of Australia (CMBA) under AHPRA.
All practitioners providing these services are registered with the Australian Health Practitioner Regulation Agency (AHPRA) and comply with the relevant approved professional standards, codes, and guidelines.
1.3 Definitions
"Client" means any individual who books, pays for, or receives services from the Practice.
"Consultation" means an in-person, telehealth, or hybrid session between a Client and a registered practitioner.
"Payment Platform" means the Stripe payment processing infrastructure integrated into the Practice's booking system.
"Sensitive Health Information" has the meaning given in the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
"Telehealth Consultation" means a consultation delivered remotely via video, telephone, or other electronic means.
2. Payment Terms
2.1 Payment Processing
All payments are processed securely through Stripe, Inc. ("Stripe"), a third-party payment processor. By submitting payment, you authorise the Practice to charge the nominated payment method for the agreed service fee.
The Practice does not store your full card number, CVV, or bank account details. All cardholder data is handled exclusively by Stripe in accordance with the Payment Card Industry Data Security Standard (PCI-DSS). Stripe's privacy policy and terms of service are available at stripe.com and apply in addition to these Terms.
2.2 Fees and GST
All consultation fees are listed in Australian Dollars (AUD) and are inclusive of Goods and Services Tax (GST) where applicable, in accordance with the A New Tax System (Goods and Services Tax) Act 1999 (Cth). Healthcare services that qualify as GST-free health services under Division 38-B of that Act will be invoiced accordingly. A tax invoice or receipt will be issued upon request.
2.3 Medicare and Private Health Insurance
Certain chiropractic and Chinese medicine services may attract a Medicare benefit or private health insurance rebate. It is your responsibility to:
Confirm your eligibility for any rebate with Medicare Australia or your private health insurer prior to booking;
Provide accurate Medicare or fund membership details to the Practice when requested;
Understand that HICAPS or similar claiming services may be available in-clinic but are not processed through this online payment platform.
The Practice does not warrant that any service will attract a particular rebate or benefit. You are responsible for any gap payment between the fee charged and any benefit received.
2.4 Cancellation and Refund Policy
The Practice's cancellation and refund policy is as follows:
Cancellations made more than 24 hours before the scheduled consultation: full refund of any prepaid fee, processed within 5 to 10 business days.
Cancellations made with less than 24 hours notice: the full consultation fee is payable and is non-refundable.
Non-attendance without prior notice (no-show): the full consultation fee is charged and is non-refundable.
Refunds are processed to the original payment method via Stripe. Timing is subject to your financial institution's processing times.
Nothing in this clause limits your rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), including your rights to a remedy where a service has a major failure.
2.5 Failed or Declined Payments
If a payment is declined, the booking will not be confirmed. You are responsible for ensuring sufficient funds or credit are available. The Practice accepts no liability for any loss arising from a failed payment, including any missed appointment.
3. Healthcare-Specific Terms
3.1 AHPRA Registration and Scope of Practice
All registered practitioners at the Practice comply with:
The relevant National Board's Code of Conduct, including the CBA Code of Conduct for Chiropractors and the CMBA Code of Conduct for Chinese Medicine Practitioners;
Advertising guidelines issued by AHPRA under Section 133 of the National Law;
Relevant clinical practice guidelines endorsed by the National Boards.
3.2 Advertising Compliance (AHPRA)
In accordance with Part 7 of the National Law and AHPRA's Guidelines for Advertising a Regulated Health Service, nothing published on the Practice's website, booking platform, or payment confirmation communications constitutes:
A testimonial or representation from a patient about the clinical efficacy of a treatment;
A claim that is inaccurate, false, or misleading;
An offer of a gift, discount, or inducement to attract a patient, unless the terms and conditions of the offer are also stated;
A claim that creates an unreasonable expectation of beneficial treatment.
Any promotional pricing or introductory offer available through the online platform will clearly state the terms, duration, and conditions of the offer, consistent with AHPRA's advertising requirements.
3.3 Chiropractic - Additional Disclosures
Chiropractic services involve the assessment and treatment of conditions of the musculoskeletal system and nervous system. Prior to treatment, your practitioner will conduct a thorough health history and consent process consistent with the CBA's standards for consent and documentation.
In accordance with AHPRA and CBA requirements, the Practice does not make representations about the efficacy of chiropractic for conditions beyond the scope of evidence-based practice.
3.4 Chinese Medicine and Acupuncture - Additional Disclosures
Chinese medicine is a regulated health profession in Australia. Practitioners providing acupuncture, Chinese herbal medicine, or Chinese massage (tui na) hold registration with the Chinese Medicine Board of Australia.
Where Chinese herbal medicine products are dispensed or sold by the Practice, such products comply with applicable requirements under the Therapeutic Goods Act 1989 (Cth) and the requirements of the Therapeutic Goods Administration (TGA). Clients must disclose all current medications and health conditions to their practitioner prior to any herbal prescription.
3.5 Telehealth Consultations
Telehealth consultations are available at the Practice's discretion and are not a standard offering for all service types. Where a telehealth consultation is agreed, the following conditions apply:
You must be located in Australia at the time of the telehealth consultation;
It is your responsibility to ensure a secure and private connection. The Practice is not responsible for any breach of confidentiality arising from your use of a shared or unsecured network;
Certain assessments and treatments, particularly hands-on chiropractic adjustments and acupuncture, cannot be performed via telehealth. Your practitioner will advise if an in-person consultation is clinically necessary;
Telehealth consultations are subject to the same cancellation and refund policy as in-person consultations.
3.6 Consent to Treatment
Payment for a consultation does not substitute for the clinical informed consent process, which will be conducted by your practitioner prior to treatment. Informed consent will be obtained separately, verbally and/or in writing, consistent with the relevant National Board's standards.
4. Limitation of Liability
To the maximum extent permitted by applicable law, including the Australian Consumer Law:
The Practice excludes all implied warranties and representations in connection with the payment platform;
The Practice's total liability to you for any claim arising out of or in connection with these Terms or the payment platform shall not exceed the amount paid by you for the specific consultation to which the claim relates;
The Practice is not liable for any loss or damage arising from system outages, payment failures, or third-party platform failures including Stripe.
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited.
5. Governing Law and Disputes
These Terms are governed by the laws of Queensland and the Commonwealth of Australia. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland.
In the event of a complaint regarding a clinical matter, clients may also contact AHPRA on 1300 419 495 or at www.ahpra.gov.au, or the Queensland Office of the Health Ombudsman on 133 646 or at www.oho.qld.gov.au.
6. Amendments
The Practice reserves the right to amend these Terms at any time. Amended Terms will be posted on the Practice's website and payment platform with an updated effective date. Your continued use of the payment platform following any amendment constitutes your acceptance of the revised Terms.
